Privacy Policy

High Technology Park of the Kyrgyz Republic

1. General Provisions

1.1. This Privacy Policy (hereinafter referred to as the “Policy”) defines the procedure for the collection, processing, storage, transfer and protection of personal data and other information provided by users (hereinafter referred to as the “User”) when using the official website and information systems of the Institution “Directorate of the High Technology Park of the Kyrgyz Republic” (hereinafter referred to as the “HTP Directorate”).

1.2. This Policy applies to all information received by the HTP Directorate when using the Website and information systems, including the submission of applications for registration as an HTP resident, as well as during subsequent interaction with the User.

1.3. Personal data processing is carried out in accordance with the legislation of the Kyrgyz Republic, including the Law of the Kyrgyz Republic “On the High Technology Park of the Kyrgyz Republic”, the Digital Code of the Kyrgyz Republic, as well as other regulatory legal acts.

1.4. Use of the Website and (or) submission of an application means that the User has read this Policy and agrees to its terms.

2. Categories of Data Processed

2.1. The HTP Directorate processes the following categories of data:

1) Identification and registration data:

– name of the legal entity / full name of the individual entrepreneur;

– registration and constituent documents;

– information on founders, participants (shareholders), beneficial owners;

– contact details (telephone number, email address).

2) Documents and information submitted for registration:

– business plan;

– financial and accounting documentation;

– other documents provided for by the legislation on the HTP.

3) Technical data:

– IP address;

– cookies data;

– information on the device, browser and operating system;

– date and time of access;

– information on the User’s actions in the information system.

2.2. Technical data is processed for the purposes of ensuring the functioning of the Website, information security, recording the User’s actions and preventing unlawful actions.

2.3. The HTP Directorate does not carry out the targeted collection of special categories of personal data, except in cases expressly provided for by the legislation of the Kyrgyz Republic.

3. Purposes of Data Processing

3.1. Personal data is processed exclusively for the following purposes:

– consideration of an application for registration as an HTP resident;

– conducting an expert review by the Expert Council;

– making decisions on initial registration or refusal;

– interaction with the User within the framework of application review;

– ensuring the functioning, security and proper operation

of the Website and information systems;

– recording legally significant actions of the User;

– maintaining records, monitoring and analyzing the activities of HTP residents;

– compliance with the requirements of the legislation of the Kyrgyz Republic.

3.2. Data processing is not carried out for purposes unrelated to the functions and tasks of the HTP, except in cases provided for by legislation.

4. Legal Grounds for Data Processing

4.1. Personal data processing is carried out on the following grounds:

– the User’s consent, expressed by using the Website and submitting an application;

– the necessity of processing for the performance of the functions and powers of the HTP Directorate established by legislation;

– the requirements of regulatory legal acts of the Kyrgyz Republic.

5. Conditions for Data Processing and Transfer

5.1. The HTP Directorate ensures the confidentiality of the processed data and does not disclose them to third parties, except in the following cases:

– to state authorities — in cases and in the manner provided for by the legislation of the Kyrgyz Republic;

– to authorized employees of the HTP Directorate, within the limits of their official duties;

– to contractor organizations ensuring the functioning of information systems (including IT infrastructure), provided that they comply with confidentiality requirements.

5.2. Transfer of data to third parties in other cases is allowed only with the User’s consent or in cases expressly provided for by the Digital Code of the Kyrgyz Republic.

6. Data Retention Periods

6.1. Personal data is stored for the period necessary to achieve the purposes of their processing, as well as for the periods established by the Digital Code of the Kyrgyz Republic.

6.2. Data may be stored longer in cases where this is necessary for:

– compliance with the requirements of the legislation on the High Technology Park of the Kyrgyz Republic;

– protection of the rights and legitimate interests of the HTP Directorate;

– ensuring an evidentiary basis for legally significant actions.

8. User Rights

8.1. The User has the right to:

– receive information about their personal data and the procedure for their processing;

– demand clarification, updating or correction of data;

– demand restriction or termination of processing in cases provided for by legislation.

8.2. The User has the right to withdraw consent to the processing of personal data by sending a corresponding application to the HTP Directorate in written or electronic form.

The procedure for withdrawing consent must not be more burdensome than the procedure for granting it.

Withdrawal of consent does not entail the automatic termination of personal data processing if such processing is carried out on other legal grounds provided for by the legislation of the Kyrgyz Republic.

If the processing of personal data is necessary for reviewing an application or performing the functions of the HTP Directorate, withdrawal of consent may result in the impossibility of further review of the application or refusal of registration.

8.3. The exercise of rights is carried out in the manner established by the legislation of the Kyrgyz Republic.

9. Data Security

9.1. The HTP Directorate takes the necessary and sufficient organizational and technical measures to protect personal data, including:

– restriction of access to data;

– use of information protection means;

– accounting and recording of the actions of users and employees in the system;

– prevention of unauthorized access, modification, disclosure or destruction of data.

10. Use of cookies and technical means

10.1. The HTP Directorate may use cookies files and other technical means to ensure the functioning of the Website, analyze its use and improve the convenience of working with the system.

10.2. The User has the right to change the cookies settings in their browser.

11. Amendment of the Policy

11.1. The HTP Directorate has the right to make amendments to this Policy.

11.2. The current version of the Policy is posted on the Website.

11.3. Continued use of the Website after amendments have been made means the User’s consent to the new version of the Policy.

12. Final Provisions

12.1. This Policy and the relations arising in connection with its application shall be governed by the legislation of the Kyrgyz Republic.

12.2. This Policy is a publicly available document and shall be posted on the Website of the HTP Directorate.
